RELEVANSI SANKSI KEBIRI KIMIA DALAM PERPU NO. 1 TAHUN 2016 TENTANG PERUBAHAN KEDUA ATAS UNDANG-UNDANG NOMOR 23 TAHUN 2002 TENTANG PERLINDUNGAN ANAK TERHADAP TUJUAN PEMIDANAAN

ABSTRACT
Tis research was conducted to fnd out the relevance of chemical castration sanctions against the criminal purpose. Tis research used normative method. Te results showed that chemical castration sanctions in Government Regulation No. 1 year 2016 has not met all elements of the criminal purpose. An elements of covered is revenge element and the deterrent element. While protection of the public element and rehabilitation of the criminal is still relatively and needs to be proven deeper.

INTISARI
Penelitian ini dilakukan untuk mengetahui relevansi sanksi kebiri kimia terhadap tujuan pemidanaan. Penelitian ini menggunakan metode normatif. Hasil penelitian menunjukan bahwa sanksi kebiri kimia dalam Perpu No. 1 Tahun 2016 tidak memenuhi semua unsur tujuan pemidanaan. Unsur yang dipenuhi adalah unsur pembalasan dan unsur menjerakan. Sedangkan unsur Perlindungan terhadap kepentingan umum dan memperbaiki pelaku masih relatif dan perlu dibuktikan lebih dalam.
